General conditions of sale

§ 1. General conditions

All the services performed by the vendor by means of the online shop are carried out on the basis of the following general conditions of sale. Standards differing from the general conditions of sale must be agreed between the user and the provider.

§ 2. Offer

2.1 The offers for sale through the online-shop in which the customer is invited to make an order are not binding.
2.2 Through an online order of the required goods, the contractual offer to the user is binding.
2.3 The order will be confirmed immediately after it is received by the vendor. The order confirmation and telephone orders are not considered to be a binding conclusion of the sales contract by the vendor. This happens at the moment that the vendor gives the goods to the shipping company. The user will be informed of shipping by a confirmation email.
2.4 The goods ordered by the user are considered the object of the sales contract. The description of the goods constitutes the characteristics of the product.

§ 3. Cancellation

Right to cancel
The customer has the right to withdraw from the contract without penalty and without supplying a motive within 14 (fourteen) days via letter, fax or email. The term starts as soon as the vendor receives a written instruction and not before the delivery of the goods to the purchaser and the obligatory information by the vendor. In order to respect the cancellation terms, all that is needed is to send promptly a declaration of cancellation to the following address:

Consequences of withdrawal
In the case of a cancellation the services received from both parties must be reimbursed, including possible earnings (e.g. interest) In the case that the user is not able to return the ordered goods, or returns them in part or damaged, he must pay compensation equivalent to the value of the purchased goods. This is not the case if the deterioration of the object is due to a failure to inspect the goods – which would be possible buying the goods in the shop. Moreover, the user can avoid the obligation of compensation for the value of the goods (which happens when it is used, leaving traces of wear) not using it and therefore not considering it his property. In this case the value of the goods remains unchanged. Refunds of payment must be made in 30 days. The period begins for the user with the sending of the notice of cancellation and for the vendor with the receipt of the notice of cancellation.
Please note:
The right of cancellation is less if the product has been produced on the basis of specific indications from the user or on the basis of obvious personal needs of the user and in the case that it is not possible to return the goods due to their specific characteristics.

§ 4. We would also like to let you know:

4.1 If it is available, ordered goods will be shipped immediately.
Shipping is available to Italy and other European Union countries.
4.2 The time for domestic shipment is max. 10 working days (unless otherwise specified)
The time for international shipment is max. 15 working days (unless otherwise specified).

§ 5. Costs of postage and packing

5.1 We offer the following shipping options: standard and express Standard und Express
5.2 A domestic shipment (including packing) will incur the following costs:
  • The shipping costs indicated in the offer. The shipping costs will be communicated individually for each order
  • (The price in Euro varies according to the weight)
  • For International shipments we calculate 17 Euro (unless otherwise specified).
  • International orders with a value of more than 500 Euro will be shipped free of charge.

§ 6. Payment and rights of title

6.1 Public prices are in Euro, gross, and including VAT (currently 21 %). The price applied is the one on the day the order is made.
6.2 For domestic orders we accept payment:
  • By credit card
    The card will be debited when the goods are shipped. We accept the following credit cards: : Visa, Mastercard, American Express
  • Advance payment
    In this case the client will pay the cost of the articles via bank transfer. Following this he will receive an email confirming the details of the invoice.
    For this reason it is necessary for the client to indicate his email address on the order form. The client is also asked to indicate the reason for the payment, the name of the buyer and the order number in order to be able to correlate the payment received with their order.
6.3 The goods sent remain the property of the vendor until the payment is received. The user must immediately inform the online-shop if the goods are passed to a third party. This is also the case for other types of damage. The user is also obliged to inform third parties about their rights to the goods.

§ 7. Product guarantee

If the user discovers damage caused by shipping, they are requested to make a damage report to the carrier. For other shipping damage they are requested to contact the vendor within ??? days. Failure to complete a damage report does not affect your rights under the guarantee from the vendor. The guarantee is covered by the current legislation.

We are not liable for defects arising from faulty handling, normal wear or by third parties. In the case that repairs are made by the user or third parties without prior approval from the vendor, the guarantee is void.

§ 8. Liability

8.1 The vendor has unlimited liability in the case of intent or gross negligence under current legislation. The guarantee is given independently of liability. The online shop accepts responsibility for slight negligence according to goods liability legislation, for the endangerment of life, health, personal injury as well as breach of contract. Claims for compensation due to breach of contract is limited to foreseeable damage inherent in the contract, in so far as it is not liable for injury, or damage to life or health. Similarly the online shop accepts liability for damage caused by employees or legal representatives.

8.2 Regulation of the preceding paragraph (8.1) refers to compensation including performance, compensation in lieu of the provision and replacement due to performance in vain, regardless of the legal argument, including the guarantee in case of defective goods, delays or if it is impossible to

§ 9. Data protection

We inform our customers that we record the data necessary to conduct the sale. Personal details of the user will be treated with the utmost case and will only be used to complete the order.

§ 10. Law enforcement

In the event that the contractor is a trader, legal person or a special fund of public policy, the venue for any lawsuit relating to the purchase agreement is the Regional Court in Bolzano. The right of Rowi sculptures to sue the contractor at his court remains intact.

§ 11. Final clauses

Every contract is based on Italian law, excluding the UN right to purchase. On placing an order, the user declares that he accepts the general terms and conditions of sale of the online-shop. If one of the clauses of the general terms and conditions should prove to be invalid, for whatever reason, the validity of the other clauses remains intact.

An ineffective completion implies recourse to the legal ruling in force. In the case that the user does not have a place of jurisdiction in Italy or one of the countries of the European Union, our court will be considered the only place of jurisdiction for an type of legal action.
